NDOWRA Board Advocates for Installer Representation in Legislative Hearings on HB 1541 and SB 2267

This week, Board Members Bruce Ellingson, Terry Novak, and Darren Jesperson attended legislative committee hearings on HB 1541 and SB 2267.

During the HB 1541 hearing, some legislators were familiar with the history of efforts to establish uniform onsite wastewater and septic system guidelines for design, permitting, and installation. It was interesting to hear from legislators who have come to appreciate the importance of our work, as well as those with no knowledge of it, often because they represent urban areas.

HB 1541 proposed that all future work related to committee development and regulation be controlled by the Department of Environmental Quality (DEQ). However, the bill carried a substantial cost, including nearly $300,000 annually for a DEQ engineer, while allowing for only limited representation from installers—YOU!

Alternatively, SB 2267, though requiring significant discussion and amendments, provides a stronger framework. It aims to establish a committee with proper installer representation, ensuring meaningful input in shaping and governing onsite wastewater and septic system design, permitting, and installation. Additionally, it supports self-governance for installers, including licensing, inspections, and continuing education.

During the hearings, the Plumbing Board made it clear that, having distanced itself from onsite wastewater and septic system governance years ago, it has no intention of re-engaging—regardless of whether doing so would benefit North Dakota citizens.
