Proposed Amendments to ND Administrative Code: Onsite Wastewater Treatment System Installers Licensing

The North Dakota Department of Environmental Quality (DEQ) has announced proposed amendments to Chapter 33.1-21-01 of the North Dakota Administrative Code, addressing licensing requirements for onsite wastewater treatment system installers.

Key Points in the Proposal

  1. Transition Period for Current Licenses
    • Any onsite wastewater treatment system installer license issued by a local public health unit under ND Century Code section 23-35-08 that is valid on July 31, 2025 will remain in effect until December 31, 2026, or until DEQ adopts new licensing rules-whichever comes first.
  2. Licensing for New Installers During Transition
    • From the effective date of the amendment until December 31, 2026 (or until new DEQ licensing rules are adopted), installers who are not currently licensed will be able to obtain a license directly from DEQ.
    • Applicants must submit an application form prescribed by DEQ.
  3. Authority and Implementation
    • This proposed change is made under NDCC 23.1-07.1-02 and implements provisions of NDCC 23.1-07.1-02 and 23.1-07.1-03.

Why This Matters

This amendment marks a significant step in DEQ’s expanded oversight of septic system regulations in North Dakota. The transition period gives current license holders stability while also creating a path for new installers to join the field without waiting for the full rulemaking process to conclude.
