Legislative Update: SB 2276 & HB 1541 Status

Good morning North Dakota septic installers and all those interested in on-site wastewater treatment systems,

This is a brief update on the progress of the two bills we’ve been following closely: SB 2276 and HB 1541. Both bills are currently in limbo. They have each gone through committee hearings, during which testimony was offered both in support and opposition. They now await either a “do pass” or “do not pass” vote.

If both bills pass, they will move to a conference committee where they will be combined into one bill and then sent to the Governor for approval or veto. Unfortunately, during the conference committee process, public testimony is not allowed-although departments like the DEQ are still permitted to offer their input. This seems a bit one-sided.

We encourage all installers and those with an interest in this industry to read these bills carefully. There are some positive aspects, but also several concerning ones. The biggest concern is that installers risk losing their voice in the process. Our main goal must be ensuring that we have a voice in whatever final bill emerges. The Governor will ultimately decide whether to pass or veto the bill, so there is still time to make our voices heard.
